Child marriage laws

The repository of child marriage laws of the Gender Equality Observatory for Latin America and the Caribbean gathers more than 30 normative bodies and legal rulings, classified by country, from 31 countries in Latin America and the Caribbean, in addition to the legislation of Spain and Portugal on this issue.

These laws are classified into: those of countries that absolutely prohibit marriage before the age of 18; those that allow marriage from the age of 16 through judicial authorization or legal representatives; and finally, those that allow it before the age of 16 for qualified reasons.

Child marriage is currently prohibited in 9 countries in Latin America and 2 in the Caribbean. The last country to legislate this prohibition was the Dominican Republic in January 2021.

    LEY QUE MODIFICA EL CÓDIGO CIVIL, DECRETO LEGISLATIVO 295, A FIN DE PROHIBIR EL MATRIMONIO DE PERSONAS MENORES DE EDAD

    Toda persona mayor de dieciocho años tiene plena capacidad de ejercicio. Esto incluye a todas las personas con discapacidad, en igualdad de condiciones con las demás y en todos los aspectos de la vida, independientemente de si usan o requieren de ajustes razonables o apoyos para la manifestación de su voluntad.

    Prohíbe el matrimonio entre personas menores de 18 años.

    Decreto por el que se reforman y derogan diversas disposiciones del Código Civil Federal, en materia de prohibición del matrimonio infantil.

    Modifica el artículo 148 del Código Civil Federal, estableciendo que para contraer matrimonio es necesario haber cumplido 18 años de edad.

    Lei 13.811, Confere nova redação ao art. 1.520 da Lei nº 10.406, de 10 de janeiro de 2002 (Código Civil), para suprimir as exceções legais permissivas do casamento infantil

    Modifica el artículo 1520 del Código Civil, estableciendo que no se permitirá el matrimonio de quienes no hayan alcanzado la edad núbil, en cumplimiento del artículo 1517, el cual prescribe que los hombres y mujeres de dieciséis años pueden contraer matrimonio, previa autorización de ambos padres o de sus representantes legales, hasta alcanzar la mayoría de edad.

    Honduras

    Decreto 44-2017

    Deroga el párrafo tercero del Artículo 16 del Código de Familia; a su vez reformado mediante el Decreto No.35-2013, Código de la Niñez y la Adolescencia. Ambas normas permitían excepcionalmente el matrimonio de menores de 18 años. A través del presente decreto se prohibe en forma absoluta.

    Decreto 13-2017

    Modifica el artículo 83 del Código Civil, estableciendo que no podrán contraer matrimonio ni autorizarse de manera alguna, el matrimonio de menores de 18 años de edad (art.2).

    El Salvador

    Decreto 754

    Deroga el inciso segundo del artículo 14 del Código de Familia, el cual establecía que se permite el matrimonio los menores de 18 años si siendo púberes, tuvieren ya un hijo en común, o si la mujer estuviere embarazada. A través de esta reforma, los menores de 18 años no podrán contraer matrimonio bajo ninguna circunstancia.

    Trinidad and Tobago

    Miscellaneous Provisions (Marriage) Act

    This act amends the Marriage and Divorce Act, Chap. 45:02, the Hindu Marriage Act, Chap. 45:03, the Orisa Marriage Act, Chap. 45:04 and the Matrimonial Proceedings and Property Act, Chap. 45:51. Through the modification introduced by Section 3, the marriage of minors under 18 years of age is absolutely prohibited.
