Social Security Act and Social Security (Benefits) Regulations (Revised up to 31 December 2017)
Establishes the conditions for the benefits of maternity allowance and maternity grant. According to the Social Security (Benefits) Regulations, maternity benefit shall be awarded to a woman who is an insured person in respect of her pregnancy and confinement, paid for a period starting on a date not earlier than six weeks before the expected date of confinement and continuing until the expiration of thirteen (13) weeks. The daily amount of maternity allowance shall be sixty-five percent (65%) of the average weekly wages of the insured person, divided by six. Maternity grant shall be awarded to a woman who is the wife of an insured person, in respect of her pregnancy and confinement, who doesn't qualify for maternity benefits on her own. Except that if a woman is at the same time an insured person and the wife of an insured person, then maternity grant shall be awarded to her either as the insured person or as the wife of the insured person and not in both capacities. The amount of maternity grant shall be paid in accordance with Schedule 6 to these Regulations in respect of each child born at one confinement. For both maternity benefit and grant, the major condition for eligibility is that the insured person has been insured for a period of at least thirty-nine contribution weeks, and not fewer than twenty contributions have actually been paid out of the thirty-nine continuous contribution weeks.
